These Terms & Conditions ('Terms') govern your use of ozoneproduction.com and the services provided by Ozone Production. By booking services or using this site, you accept and agree to these Terms. If you do not agree, please do not use the site or request services.
1.1 Scope. These Terms apply to all visitors, clients, and users of Ozone Production's website and services. 'Client' refers to any individual or entity that engages Ozone Production for photography services.
1.2 Agreement. By accessing the website or booking services, you confirm that you are authorized to enter into this agreement and accept these Terms. Where applicable, a separate written service agreement (estimate or contract) will govern specific project details and take precedence for that engagement.
2.1 Service Types. Ozone Production offers professional photography services including event, portrait, commercial, and product photography. Service deliverables, durations, and timelines are defined in the project estimate or contract.
2.2 Scope Changes. Any changes to scope—additional time, travel, retouching, or usage rights—require a written change order and may incur additional fees. Estimates are valid for the period specified in the estimate document.
3.1 Quote and Deposit. Bookings require an accepted written estimate or contract and payment of the required deposit to reserve the date. The deposit amount and due date are stated in the estimate or contract.
3.2 Final Payment. Final payment is due as specified in the contract—typically before delivery of final images. Ozone Production will not release final deliverables until outstanding balances are paid in full.
4.1 Client Cancellation. If the Client cancels the booking, the deposit is non-refundable unless otherwise stated in the contract. Cancellation fees may apply depending on timing and expenses already incurred.
4.2 Ozone Cancellation. If Ozone Production must cancel due to illness, emergency, or force majeure, we will notify the Client promptly and either reschedule the services or refund any prepaid fees for services not rendered.
5.1 Ownership. All original photographs, negatives, digital files, and associated copyrights are owned by Ozone Production unless a separate written agreement assigns ownership to the Client. Ozone Production retains copyright by default.
5.2 Usage Rights. The Client is granted the usage rights specified in the contract (e.g., personal, commercial, or editorial use). Usage beyond those rights requires additional licensing and payment.
5.3 Attribution and Credit. When images are published publicly and contractually required, credit should be given to Ozone Production in the form specified in the agreement.
5.4 Client-Supplied Materials. The Client warrants they have the right to provide any logos, trademarks, or third-party materials and will indemnify Ozone Production for claims arising from their use.
6.1 Cooperation. Clients must provide accurate project information, secure permissions and location access, and arrive on time. Delays caused by the Client may add charges or shorten coverage time.
6.2 Property & Safety. The Client is responsible for protecting personal property, and must ensure a safe environment. Ozone Production reserves the right to suspend services if conditions pose a safety risk.
7.1 No Consequential Damages. Except where prohibited by law, Ozone Production's liability for any claim related to services or the website is limited to the total fees paid by the Client for the applicable services. Ozone Production is not liable for indirect, incidental, consequential, or special damages.
7.2 Force Majeure. Ozone Production is not responsible for failure to perform due to events outside its reasonable control, including but not limited to acts of god, government action, pandemics, or severe weather.
8.1 Client Indemnity. The Client agrees to indemnify and hold harmless Ozone Production and its contractors from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from the Client's breach of these Terms, misuse of images, or any third-party claims related to materials supplied by the Client.
9.1 Choice of Law. These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. Any legal action arising out of or relating to these Terms shall be brought in state or federal courts located in California unless otherwise agreed in writing.
10.1 Amendments. Ozone Production may amend these Terms from time to time. Material changes will be posted on the website with an updated Effective Date. Continued use of the site or services after posting constitutes acceptance of the revised Terms.
10.2 Client Notice. For existing bookings, the Terms in effect at the time of the booking will govern that engagement unless otherwise agreed in writing.
